1. I intend to develop myself in a positive manner, and to avoid anything which may reduce my mental growth or physical health.

DISCLAIMER

The undersigned student or parent/guardian {guardian_name} understands the risk of studying martial arts and hereby releases Martial Arts Fitness of Boca Inc, DDL Corp Inc, all instructors, staff, and students of Extreme Velocity Martial Arts LLC from any and all liabilities for any type of injuries or loss sustained while playing, training, studying and practicing in the application of martial arts and its classes, camp, and/or after school care programs.

This Membership Agreement is made and entered into as dated above by and between Extreme Velocity Martial Arts LLC a Florida Limited Liability Company, located at 5970 S.W. 18th Street, Unit E8, Boca Raton, FL 33433, referred to as "Facility" and undersigned as "Member", "Guardian", and or "Student".

Terms and Conditions

The terms of this contract A, B, C, D, E, F, G, and H, will begin on the date signed and will be perpetual unless otherwise stated. All sales are final and non refundable. Month to Month Basis with Thirty (30) day cancellation option as per cancellation of membership requirements herein.

A) Cancellation of Membership

Except as provided below, this Membership Agreement (“Agreement”) can only be cancelled at the end of Term by giving prior written notice. If Student/Member does not give written notice of cancellation, this Agreement shall automatically extend on a month-to-month basis, at the then effective month-to-month rate. This Agreement may be cancelled prior to the end of Term upon the death or disability of the Student/Member, or if Member moves more than 15 miles from the Facility. To cancel this Agreement prior to the end of the Term you must deliver a signed and dated written notice of cancellation and third party confirmation of the reason for cancellation (e.g. Physician’s Order, either: 1. By personal delivery to the studio/facility; or 2. By registered or certified mail to the Facility. Cancellations permitted under the Agreement will take effect on the last day of the month following receipt by Facility of all required documentation. Memberships at the Facility are transferable at the discretion of said Facility.

B) MEMBERSHIP FREEZES

Student/Member is permitted to freeze membership for one or two months one time during the initial Term, or if Student/Member is on a month-to-month basis, then one time per calendar year. If the freeze period is during the initial Term, Student/Member must continue to pay tuition/dues in full and the freeze time will be added to the end of the initial Term. If Student/Member is on a month-to-month basis, Student/Member may suspend payment of tuition/dues until the end of the freeze period. To effect a membership freeze, Student must submit and a signed and dated written notice of freeze and third party confirmation of the reason (e.g. Physician’s Order) either; 1. By personal delivery to the Studio/Facility; 2. By registered or certified mail to the Facility.

C) MONTHLY TUITION/DUES

Except as expressly provided herein, all tuition/dues and/or payments are non-refundable. Tuition/Dues are billed monthly, in advance, on the first day of each month, due and payable at the time of billing – regardless of usage of the academy/Facility. At the end of the initial Term, monthly tuition/dues will continue on a month-to-month basis at the then effective rate.

D) DECLINED OR DELINQUENT PAYMENTS

In the event Student/Member fails to pay any obligation in accordance with the terms of this Agreement, Facility may refuse to honor the Student/Member’s membership. In addition, should Student/Member be in default of any payment for more than 30 days, all amounts due hereunder shall become immediately due and payable. Facility reserves the right to use an attorney to enforce any terms under this Agreement and Student/Member shall be liable, in addition to any other obligations, for the cost of such enforcement.

E) ASSUMPTION OF RISK & WAIVER OF LIABILITY

Student/Member represents that he/she is in good physical condition and is able to use the facilities of Facility. Student/Member hereby acknowledges that he/she is fully aware of the risks and hazards inherent in the practice of martial arts and in fitness activities and hereby assumes voluntarily all risks of loss, damage or injury (including death) that may be sustained by Student/Member or to his/her property. Student/Member hereby accepts full responsibility for the use of, or participation in, any and all classes, services, equipment, demonstrations or events, whatsoever owned, operated or sponsored by Facility, representatives and agents from any and all loss, claim, injury, damage or liability sustained or incurred by Student/Member resulting there from. This release shall be binding upon the heirs, distributes, next of kin, executor and administrator of each of the undersigned. In signing this Agreement, the undersigned hereby acknowledges and represents that he/she has read this release, understands it and signs it voluntarily.

F) DAMAGE TO PROPERTY

If Student/Member willfully or neglectfully does damage to any Facility property, the cost of repairing or replacing such damaged property shall be paid for by Student/Member.

G) MEMBERSHIP RULES & REGULATIONS

Student/Member hereby agrees to abide by all rules and regulations of Facility, which may be posted or issued verbally, as amended from time to time. Facility may terminate this Agreement for violation of any rule or regulation, or any conduct which is detrimental to the welfare or character of Facility or its students/members.

H) ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between Student/Member and Facility. Amendments or modification to this Agreement must be in writing and signed by both Student/Member and Facility.

I accept all the terms and conditions of this Membership Agreement and may have received a copy.

RELEASE AND CONSENT FOR STUDENT PHOTO AND VIDEO PUBLICATION

I release and consent for all student photographs and videos to be publicized perpetually. I hereby give permission for Extreme Velocity Martial Arts LLC to use my child’s photograph, video image, voice recording, belt level, name, participation in officially recognized activities and sport, diplomas and awards received, web sites, social media sites such as Twitter, Facebook, Instagram, and others. I understand that by signing this form my child’s photograph and videos can be used in any publications or presentations from Extreme Velocity Martial Arts LLC and/or any of its affiliated partners.
